Can I kick someone out if they pay rent and receive mail but are not on the lease.?

When I moved into my place I had a friend with family %26amp; personal problems. I offered to let her stay with me but she would have to help out with rent. There never was an agreement on how long she could stay. She also helped pay some of the deposit. She has become irrational,hostile %26amp; starting fights with me so I finally said enough %26amp; gave her 30 days to move out. I told her that upon her moving out that I would assess any damages %26amp; pay her deposit back accordingly %26amp; also deduct utilities from the deposit. She now has become disrespectful to my personal space,reason to believe that she's been abusing my dog. She brought over a strange guy took him into my shower did god knows what. I went down stairs while they were in there %26amp; I heard my dog yelping in pain upstairs. I felt uncomfortable felt my dog was unsafe, I was going out of town so asked her to leave 3 days early%26amp; get the rest of her stuff when I was back. Can I kick her out? If her name is not on the lease, you definitely can legally kick her out. It doesn't matter if she paid rent in the past. That rent was for when she was there. Remember that rent is paid a month in advance, so you will owe her for any back rent she paid and her portion of the security deposit, but other than that you are more than free to boot her if you want to. She has no legal right to be there if you and her didn't sign anything together. You don't even have to give her 30 days notice. you can kick her out, but you may also be kicked out.


She is not on the lease, give her all her money back, and if you can, get her this months rent money back and have her sign a paper agreeing or consenting to it. You bite the bullet on any cost you suffer, but it gets rid of the crazy lady living in your home.


otherwise you risk being sued by the crazy lady, and probably winning, but you need to watch some crappy daytime tv, preferably the court shows....i only watched cause i dont have cable tv.
It is your place, you had no agreement, if I were you, I'd kick her out ASAP, before she seriously injures your dog and/or property. And, no, you are not wrong. You have every right to kick her the hell out.
That is forgery. You are on the agreement. Kick her out or get the police involved for trespassing and animal abuse. She is an intruder and has worn out her welcome.





You can settle for a restraining order. Don't be nice to her. She is not even your friend. She is a user or drug user.
If she has damaged anything that you can prove ... try getting a restraining order on her ? I think that is what I would try first. But won't issue one in Ohio unless there is some kind of physical evidence she is destructive or dangerous. I'm not sure about threats or animal abuse - give the local court house a call.

If she is violent or is causing you harm, you can call the police and have her arrested, even for pet abuse. That way, you will have just cause to get a restraining order for her and she will have to move. Call the police at any reasonable confrontation.
she is not on the lease, and there is no written agreement between the both of you nor any proof of how long she has been there. so it's just your word against hers.





just kick her out and if she gives you any crap call the police on her and have her escorted out of your home and press charges for animal cruelty.





as for her mail, you can have anybody you want to use your address. several of my family and friends use my address and don't live in my home.

Kick her out immediately. I say pack up her stuff, throw it outside and change the locks. The police can intervene since you aren't married and she isn't officially on the lease.





Also make sure to take legal action for what she did to your apartment AND YOUR DOG. People who abuse animals should be punished. Good luck, if you need help, hell I'll kick her a** out

my son has been so upset with some people he let stay with him..that he drove them with their luggage to a hotel and paid for 3 nights........(he never gave them a key to his home so did not change the locks) my son does not have to call the police..he just gets rid of them.....


they are a ';paying guest';....';guest'; being the key word..and when they behave badly..you owe them nothing..
IF SHE'S BEEN THERE MORE THAN 30 DAYS IT'S CONSIDERED HER RESIDENCE ALSO. IF YOU JUST KICK HER OUT SHE CAN SUE YOU FOR ';ILLEGAL EVICTION'; AND SHE CAN SUE YOU. BUT, IF YOU WANT HER OUT THAT BAD CALL THE COPS, WRITE A REPORT, AND WHEN SHE'S NOT THERE CHANGE THE LOCKS AND TAKE HER BELONGINGS TO HER PARENTS HOME. JUST DEAL WITH THE CONSEQUENCES AND DON'T TAKE IN ANYONE ELSE INTO YOUR HOME. IT'S NOT WORTH THE HEADACHES.


WHY WOULD YOU ALLOW HER TO BRING ANYONE INTO YOUR HOME. YOU SHOULD'VE SET SOME GROUND RULES BEFORE SHE MOVED IN.


YOU SHOULD'VE TAKEN THE HINT AS OF WHAT WERE THE PROBLEMS WITH HER FAMILY. WHY TAKE OVER THEIR PROBLEMS.


BTW: IF SHE KICKS YOUR DOG AGAIN ...KICK HER !!!





WHEN SHE LEAVES MAKE SURE SHE TAKES 'EVERYTHING'; WITH HER AND MAKE SURE YOU CHANGE THE LOCKS. MAKE SURE TO LEAVE YOUR KEYS WITH SOMEONE YOU CAN TRUST WHO CAN CHECK ON YOUR PLACE WHILE YOU'RE GONE 'CAUSE YOU DON'T WANT TO COME BACK AND FIND YOUR THINGS MESSED UP OR MISSING. ALSO TELL YOUR NEIGHBORS IF THEY SEE HER TO CALL THE COPS AND CALL YOU IMMEDIATELY.
You are on very shakey legal ground you are in fact her landlord and you have to follow your states laws Yoiur Land lord may be able to kick her (or both of you) if he had a no sublet clause in the lease tread lightly and board your dog with a friend and hopefully she will clear out in the 30 days which is probably entitled to after that you can begin formal


eviction proceedings.
if the person is not on the lease, call 911. the police can remove her and you can file a trespassing charge against her.
