How to make tenants pay rent ?

Ok so I need help my dad has tenants who have not paid rent for like 3months and they get help from section 8 , and he said legally he cant do outragous things like change the locks or harshly demand money cause they can call the cops on him is there anything he can do aside from going to court cause that can take up to 4 months and they'll still be there without payin he's told them to pay it but they say they dont have the money and he goes to talk to them and the never answer the door PLEASE HELP !! and he does everything they ask fix this look at this and that , and they cant pay lil rent thats stupid they still have help with not having to pay a whole amount , if it was up to me id go and wait on them and demand they give me whatever they had in their pocket cause i know legally if they owe money like that you as the landlord you can do that


please if anyone knows what we can do I would appreciate it

You have to get them evicted them you have to sue them for the money they owe you.How to make tenants pay rent ?
The only thing he can do legally is have them served with a thirty day eviction notice by the local constable.If they don't leave after that they can be arrested for trespassing.On day 30 the constable will go make sure they are out.It's better than waiting for monthes.Your dad would need to contact the local constable to start the process.I believe there is some cost involved,but not much.My dad used to have a rent house too.He ended up selling it,because it was more trouble than it was worth.
well what does the lease say? Eviction is the next step after the proper notices have been served. If there are receiving section 8, shouldn't the rent payments be received directly by your father and should \nt that take care of it, or unless section 8 is partial.





Eviction is next. have your dad serve them a notice, whatever is in the lease, like 5 days notice, 10 days. whatever. talk to his attorney, i'm quite sure he has one.
Your Father is a grown adult and YOU need to stay out of his business! You don't know what you are talking about for one, and he does not need you sticking your nose in where it does not belong! Your Father is smart enough to know what to do!
your dad should contact his lawyer and get legitimate legal advice...dont trust anyone on this site to give you a good answer to deal with a situation like this.
I suggest that he does something fast because once they get over 3 months behind, we have seen that they rarely make any payments up.





So the longer your dad delays the better, they are thinking.





It's time to take them to court.
I think section 8 is the same as HUD so I'm wondering why he's not getting his check from section 8? My parents have properties for rent with HUD and HUD mailed the check to them. Now they do direct deposit. Maybe section 8 is different. If they haven't paid in 3 months they are not going to pay and he needs to go to court and evict them. Here (Huntington, WV), you just go to magistrate court and they put it on the docket for the following week. Usually the magistrate gives them 30 days to move out. The magistrate always finds in favor of the landlord but you never see the money they owe. The longer he lets them stay without paying rent, the longer it will be until he can rent to someone else. Even if it takes 4 months to evict them, that's 4 months from now if he goes ahead and files. If he waits another month or two and then evicts them that will be 5 or 6 months from now.
This is not your problem, stay out of it and focus on your career. If you even have a goal?
