i live in clarksville,tn. i was dating someone who i asked to move in with me. it did not work out between us. they are not listed on the lease or they have not helped with the rent, the only thing that they have paid for is an utility payment. how do i go about kicking them out?How to get someone to move out when they are not listed on the lease and has not helped with rent?
When you asked them to move in with you, you make them a resident and not a guest. Your right to kick them out ended when you asked them to move in.

It's no wonder it didn't work out with you paying all the rent and most of the utilities. Without a rental contract and not paying rent she is simply a guest in your house. I assume it's a she since a woman would never agree to pay all that. Anyway, she stays there at your pleasure. Having said that, if she has been living there for more than 90 days and gets mail there then it is her legal residence. You will have to give her proper notice of eviction. But it should not be hard to get that done. Eviction is designed to terminate a legally binding contract. Without that you would win by default in the first hour of court hearing. Just give her at least 14 days written notice to vacate for non-payment of rent (more in some states) before applying for a court date and politely tell her to leave. No need to be nasty, just make her face reality. If she argues or flips an attitude say, ';tell it to the judge.'; Believe me she'll be out long before that.





PS: A personal check, signed by both of you, or by the landlord, is a contract. But not if it's made out to 'Cash', or mailed out as payment for a utility bill.
You allowed this person to move in with you - they are now your tenant.





Their oral month to month tenancy is with you not your landlord.





You need to terminate their month to month tenancy by giving them proper written notice per your state's landlord tenant laws.





If they do not vacate per the notice, you are going to have to evict them at your cost.





The police will not remove them from the premises.
First try asking them to leave, and giving them a definite time period to do so (ie one week). If they do not leave in that period of time, call the police notify them of the situation and ask for assistance in having this person removed from the premises. Then arrange a time that the person will return to retrieve their belongings with a police escort.
If this person has their personal items there and has been there for any length of time, then no matter the name on the lease or lack of paying rent, this person is considered a tenant and cannot be thrown out or have police remove him. You must give 30 days notice. Sorry, but it is true. Peace:)
ask them nicely because if my boyfriend just like rudley told me and said i had to move out id get a bad attitude but ask nicely and if dat dont work call the police and i extremely like the guys idea about setting a time limit cause it does take time to find a place to move into.
If they aren't listed on the lease, they have no legal right to be there. Ask property management to change the locks and don't give out the new keys and lock the door.
Call the police if they refuse to leave.
